How to report content that infringes your copyright, how creators can respond, and what happens to infringing accounts.

The short version

Rights holders: report it.Send a complete DMCA notice to our designated agent and infringing content comes down promptly.

1 Our commitment

Netcade hosts work uploaded by independent creators, and we take copyright seriously in both directions: we remove infringing material promptly under the Digital Millennium Copyright Act (DMCA), and we protect legitimate creators from false claims through the counter-notice process.

2 Filing a DMCA notice

If you believe content on Netcade infringes your copyright, send a notice to our designated agent (below) containing all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim is infringed.
  3. The URL(s) of the infringing material on netcade.com.
  4. Your contact information (name, address, email, phone).
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for them.
Before you file

Misrepresenting a claim carries legal liability under DMCA §512(f). If you're unsure whether a use is fair use or licensed, consider consulting an attorney before filing.

3 Designated agent

4 What happens after a notice

  • Valid notices result in prompt removal or disabling of the identified material.
  • The uploader is notified and given a copy of the notice, and may file a counter-notice (below).
  • Earnings connected to the disputed content may be frozen while the claim is open (see Section 7).

5 Counter-notices

If your content was removed and you believe it was a mistake or misidentification, send our agent a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the URL where it previously appeared.
  3. A statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification.
  4. Your name, address, and phone number, and consent to the jurisdiction of the federal court in your district (or the district of our agent, if you're outside the U.S.).

If the original claimant doesn't notify us within 10–14 business days that they've filed a court action, we may restore the content and unfreeze the associated earnings.

6 Repeat infringers

Accounts that repeatedly infringe — or whose violations are egregious — are permanently terminated. Terminated infringers forfeit earnings connected to infringing content and may not re-register.

7 Earnings during disputes

Because Netcade pays creators, copyright enforcement extends to money as well as content: revenue tied to disputed uploads may be frozen during review, earnings on newly uploaded content may be held for up to 30 days for copyright review, and Netcade may reclaim or withhold payouts for content found to infringe — even after funds have been paid out.
