Terms of Service
The agreement between you and Netcade. Plain-English summaries first, the full terms below — the full terms are what governs.
The short version
1 Acceptance of Terms
Netcade ("Netcade," "we," "us") is the internet arcade — a platform where creators publish games, videos, and music, and where players discover, play, and buy that work. By creating an account or using netcade.com or the Netcade Client (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, please don't use the Service.
2 Eligibility & Accounts
- You must be at least 13 years old (or the minimum age of digital consent where you live) to create an account, and at least 18 to sell content or receive payouts.
- Give us accurate registration information and keep your credentials secure — you're responsible for activity on your account. Tell us immediately about any unauthorized use.
- One account per person. Accounts that violate these Terms may be suspended or terminated.
3 Your Content & License
You keep full ownership of every game, video, track, and image you upload. By publishing on Netcade you grant us a worldwide, non-exclusive, royalty-free license to host, store, transcode, distribute, publicly display, and promote your content — solely to operate and market the Service.
This license ends when you delete your content, with two practical exceptions: users who already purchased it keep access to what they bought, and copies may persist briefly in backups before rolling off.
By uploading, you certify that you own the rights to the content or have explicit permission to upload and monetize it. Uploading unauthorized or infringing material can result in removal, loss of earnings, account suspension, and legal consequences.
4 Content Rules & Moderation
- No illegal content; no sexually explicit content involving minors under any circumstances; no hateful or harassing material.
- No content that infringes others' intellectual property, privacy, or publicity rights.
- No malware, miners, exploits, or code that tampers with the player's device or browser.
Games are reviewed by Netcade before they become publicly playable. Videos and music may publish automatically once processing completes and can be reviewed after the fact. We may remove or disable any content at our discretion, with or without notice.
5 Purchases & Refunds
- Prices are set by creators. Payments are processed by Stripe (and PayPal where offered) — Netcade never stores your card details.
- A purchase grants you a personal, non-transferable license to access the content. It is not a transfer of ownership or copyright.
- Refunds are handled under our Refund Policy. When a purchase is refunded or disputed, the corresponding creator earning is reversed.
6 Creator Earnings & Payouts
- For each sale, creators receive the sale price net of standard payment processing (2.9% + $0.30) — the card networks' cost; Netcade retains no platform margin on sales. Paid items have a $0.99 minimum price. Ad revenue on eligible content is shared 90/10.
- Earnings accrue to your Netcade wallet. Payouts are processed by our payout partner (Trolley) and require identity verification (KYC) first.
- The minimum payout is $10. Payout-provider fees, where applicable, are shown at request time and deducted from the payout.
- You are responsible for your own taxes on earnings.
Earnings on newly uploaded content may be held for up to 30 days for copyright review and dispute resolution. We may reverse credited earnings for refunded, disputed, fraudulent, or infringing transactions — including after a payout, in which case we may request repayment or offset future earnings. Self-purchases, fake engagement, or artificially inflated sales or views forfeit the associated earnings and may end the account.
7 Memberships & Advertising
- Paid memberships bill on a recurring basis through Stripe and can be canceled anytime — cancellation stops future billing and access runs to the end of the paid period.
- The Service shows advertising. Advertisers must not misrepresent their products; ad spend flows into the creator revenue pool per the split above.
- Manipulating ad delivery, impressions, or attribution is prohibited.
8 Copyright & DMCA
We respond to copyright notices under our Copyright & DMCA Policy and terminate repeat infringers. Infringing content is removed, related earnings may be frozen or reclaimed, and egregious cases result in a permanent ban.
9 Acceptable Use
- No harassment, impersonation, or abuse of other users.
- No manipulation of reviews, ratings, ad systems, or discovery.
- No attempts to bypass payment, monetization, or access controls; no scraping at scale; no probing or disrupting the Service's security.
10 Netcade Client
- The Netcade Client (our desktop app) is required for downloadable games. We license it to you for personal use.
- Do not reverse engineer, tamper with, or modify the Client; do not bypass DRM or ad systems; do not use it to distribute malicious files.
11 Termination & Changes
- You may delete your account at any time. We may suspend or terminate accounts for breach of these Terms, infringement, fraud, or misuse.
- On termination, earnings subject to an open dispute or violation may be withheld or reclaimed; legitimate remaining balances stay payable per Section 6.
- We may change or discontinue parts of the Service, and may update these Terms — material changes will be announced on the site or by email, and continued use means acceptance.
12 Disclaimers, Liability & Governing Law
The Service is provided "as is" without warranties of any kind. User-uploaded content does not represent Netcade's views, and we don't guarantee its quality, safety, or legality. To the fullest extent permitted by law, Netcade's total liability for any claim relating to the Service is limited to the greater of $100 or the amounts you paid us in the 12 months before the claim.
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remains in effect. These Terms plus the policies they link to are the entire agreement between you and Netcade.
