Netcade Terms of Service

1. Acceptance of Terms

By accessing or using Netcade, including uploading content, playing games, or using creator tools, you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Account Registration

• You must be 13 years or older to register for Netcade.
• Provide accurate and complete registration information.
• You are responsible for safeguarding your account and login credentials. Notify us immediately of unauthorized use.
• Netcade is not liable for any losses caused by unauthorized access.

3. Content Upload & Ownership

• You retain full ownership of any game, video, artwork, or other content you upload.
• By submitting content to Netcade, you grant us a non-exclusive, royalty-free license to host, distribute, promote, and display your content on the platform.
• You confirm you have the legal rights to upload, share, and monetize all content you provide.

By uploading, you certify:

• You own the rights to your content or have explicit permission to upload and monetize it.
• You understand uploading unauthorized or copyrighted material is prohibited and can result in account suspension, loss of earnings, and legal action.

4. Copyright, DMCA & Infringement

• Netcade complies with the Digital Millennium Copyright Act (DMCA) and responds promptly to takedown notices.
• If you believe your work has been infringed on Netcade, please email [email protected] with:
  • Your name and contact information
  • A link to the allegedly infringing content
  • Proof of ownership
  • A statement under penalty of perjury
• Netcade will remove infringing content and may freeze related earnings and/or accounts.
• Repeated or egregious violations may result in permanent ban and forfeiture of earnings.
• Netcade reserves the right to reclaim or withhold payouts for any content found to violate copyright or our Terms, even after funds have been paid out.

5. Monetization & Payouts

• Creators may earn revenue from ads, tips, and platform-specific payouts.
• Eligibility for payouts may require:
  • Verification of your identity (e.g., Stripe Connect, PayPal, or government-issued ID).
  • Manual review of your content and account (especially for first-time uploads).
  • A minimum payout threshold (e.g., $5).
• Netcade reserves the right to withhold or delay payouts in cases of fraud, abuse, policy violation, or copyright dispute.
• If a payout is completed and a claim is received afterward, Netcade may request repayment and/or freeze future earnings.

6. Content Guidelines

• No illegal, hateful, or explicit material.
• No content that infringes on the rights of others.
• No malware, viruses, or exploitation attempts.
• Netcade reserves the right to remove or disable any content that violates these guidelines, with or without notice.

7. User Conduct

• No harassment, impersonation, or abuse of other users.
• No manipulation of ad systems, reviews, or ratings.
• No attempts to bypass monetization systems.
• Violations may result in account suspension or permanent bans.

8. Platform Changes

• Netcade may change, suspend, or discontinue any part of the service at any time. We strive to notify users in advance of major changes.

9. Account Termination

• You may delete your account at any time.
• We reserve the right to suspend or terminate accounts for breach of these Terms, copyright infringement, fraud, or misuse of the platform.
• Upon termination, any outstanding earnings subject to dispute or violation may be withheld or reclaimed.

10. Disclaimers

• Netcade is provided “as is” and without warranties of any kind.
• We are not liable for lost profits, lost data, service interruptions, bugs, or user-generated content.

11. Use of Netcade Client

• The Netcade Launcher and client software are required to play downloadable games.
• You agree not to reverse engineer, tamper with, or modify the client.
• Do not bypass DRM, ad systems, or upload malicious files.
